The terms and conditions below (the “Agreement”) apply to all coaching and mentoring services provided by Rise Parenting, LLC (“Rise” or the “coach”), to any individual or organization (“you” or the “client”) and constitute the contract for the service to be provided by the coach for the client.

Coaching & Content Disclaimer
Rise’s coaching services and communication, as well as information and content provided or made accessible by Rise (“content”), are intended to help you better support your PDA child and improve quality of life for your family. The coaching services and content are not offered as (and are not a substitute for) professional mental health care or medical care and are not intended to diagnose, treat, or cure any mental health or medical conditions. You also understand that your coach is not acting as a mental health counselor or a medical professional.

Confidentiality & Security
Your coach will not disclose information you provide in the course of the coaching services unless you state otherwise in writing. It will not be disclosed to a third party without the client’s prior permission, save where required by law or where action might be necessary to prevent harm to the client or someone else.

You understand that the use of technology is not always secure and you accept the risks of disclosure inherent in the use of email, text, phone, Voxer, Zoom, and any other technology.

Scheduling
The coaching schedule will be arranged between the coach and the client. When no coaching package has been purchased, sessions will be purchased on an individual basis.

Coaching sessions can take place on phone, Zoom, or Google Meet. The coach will initiate the call and provide a link as needed. Unless otherwise indicated by Rise, sessions are 60 minutes in length, but may run over by mutual agreement and paid for retrospectively, but only if the coach has no commitments immediately following the session.

Coaching sessions will be paid by the client in advance; if payment has not been received in advance of a coaching session your coach is not obliged to provide the session. Current fees are stipulated on the website (www.riseparenting.com), and the coach reserves the right to change them from time to time. Any payments for sessions paid in advance will be honored even if prices have risen between the point of booking and the time of session.

If the client needs to cancel or reschedule a coaching session, at least 12 hours notice needs to be given to the coach, via email, in order to avoid a late cancellation and/or no-show fee. (Note that most coaches require at least 24-48 hours notice, but given the unpredictability of most PDA families’ lives, Rise allows for as much flexibility as possible while also protecting the coach’s time.)

Clients utilizing Voxer coaching services can message the coach any time via text or voice memo. The coach will check messages, at a minimum, every morning and afternoon, Monday through Friday, and respond as quickly as the coach is able.

Early Termination
Should the client want to terminate coaching early, refunds for future sessions will be given on a case-by-case basis. In exceptional circumstances, the coach can decide to terminate service to the client early. In such a rare circumstance, the client will be given reasonable notice of termination by the coach where practicable and will be refunded any advance payments made for coaching sessions not yet provided.

Intellectual Property
Any materials created by Rise and provided to the client can be utilized for their personal use as long as desired. However, materials and content are Rise’s intellectual property, and Rise reserves all other rights (and without limiting the foregoing, the client cannot post them online or include them in any future venture of their own).

Limitation of Liability; Disclaimer
To the maximum extent permitted by law, you hereby release Rise (together with its owners, members, agents, successors, assigns, personal representatives, executors, heirs and employees (the “Rise Parties”)) and agree to hold the Rise Parties harmless from any and all causes of action and claims of any nature resulting from the coaching services or content, including (without limitation) any act, omission, opinion, response, advice, suggestion, information and/or service of the coach, and/or the coaching relationship contemplated by this Agreement.

You understand, agree, and acknowledge that the coaching services and content are provided "AS IS" without any express or implied warranties of any kind, including but not limited to fitness for a particular purpose or accuracy.

You understand, agree and acknowledge that Rise will not be liable to you or to any third party for any indirect, incidental, consequential, special, punitive or exemplary damages.

You understand, agree and acknowledge that Rise’s aggregate liability for damages arising with respect to the subject matter of this Agreement will not exceed the total amount of money paid by you or on your behalf to Rise in the 12-month period prior to the date of the claim.

If applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with applicable law.

This section (limitation of liability) shall survive the termination or expiration of this Agreement.

General
This Agreement shall be interpreted solely in accordance with the laws of the State of Colorado excluding any rules governing choice of laws. This Agreement constitutes the entire agreement between client and Rise with respect to its subject matter. The client confirms that they have not relied upon any promises or representations by Rise except as set forth in this agreement. The client irrevocably agrees that the exclusive venue for any action or proceeding arising out of relating to this Agreement or Rise’s relationship with client, regardless of theory, shall be the state and federal courts located in Denver, Colorado. Rise may freely transfer or assign this Agreement or any of its obligations hereunder.
